By virtue of a certified copy of a decree to me, directed from the Clerk of Superior/Circuit Court of Wells County Indiana, requiring me to make the sum as provided for in said DECREE, with interest and cost, I will expose at public sale to the highest bidder at the date, time and location listed above, the fee simple of the whole body of Real Estate, a certain tract or parcel of land described as follows:
Parcel No. 1 Part of the northeast quarter of Section 33, Township 27 North, Range 12 East, Lancaster Township, Bluffton, Indiana, described as follows: Starting at the Northeast corner of said Northeast quarter marked by a 1/4 inch square bar 7.2 feet east of the center of the pavement of Indiana State Road No. One, thence Southwesterly 648.25 feet on the center of the pavement of said State Road, thence Southwesterly deflecting right 4 degrees 19 minutes 305.12 feet on the center of the pavement of said State Road, which shall be the place of beginning, thence Southwesterly 191.38 feet on the center of the pavement of said State Road to the Northeast corner of a tract described to “Baumgartner” Deed Record 106, page 852 of the records of Wells County, Indiana, thence Westerly deflecting right 72 degrees 10 minutes 83.2 feet on the north line of said “Baumgartner” tract to a standard corner marker (5/8” rebar stake with an aluminum cap stamped Higman, 10025) on the westerly right-of-way line of said State Road, thence continuing Westerly 75.7 feet on the north line of said “Baumgartner” tract to a standard corner marker, thence Northerly deflecting right 90 degrees 00 minutes 182.4 feet to the southerly right-of-way line of Lamar Street, thence Easterly deflecting right 90 degrees 07 minutes 217.42 feet on the Southerly right-of-way liMe of said Lamar Street to the place of beginning. Containing in all 0.79 acres. EXCEPT THEREFROM, That portion of the real estate located within the former right-of-way of Fort Wayne, Bluffton and Marion Traction Company as described in Parcel No. 2. Parcel No. 2 That portion of 0.79 acre described in Parcel No. 1 located within the former right-of-way of Fort Wayne, Bluffton and Marion Traction Company. A strip of land in the northeast quarter of Section 33, Township 27 North, Range 12 East, described as follows: Beginning at a point where the West line of said public highway, known as the Fort Wayne and Indianapolis Plank Road, intersects the north line of said Section 33, thence due west along said North line of Section 33, a distance of 50 feet, thence in a southwesterly direction parallel with and 50 feet from the west line of the said Fort Wayne and Indianapolis Plank Road, a distance of 2,088 feet, more or less, to the north line of property owned by L.A. Williamson, thence due east along said north line of property owned by L.A. Williamson, a distance of 55 feet, more or less, to the west line of said Fort Wayne and Indianapolis Plank Road, thence in a northeasterly direction along said line of said Plank Road, a distance of 2,086 feet, more or less, to the place of beginning, containing 2.39 acres, more or less, Excepting, however, from this conveyance the north 320 feet of said strip of land.
Together with rents, issues, income and profits thereof, this sale will be made without relief from valuation or appraisement laws. In accordance to the requirements of IC 32-29-7-3, this Notice shall also represent service of Notice of Sale of this real estate upon the owners.
