NOTICE OF SALE OF REAL ESTATE COMMONLY KNOWN
AS 1014 S. ADAMS STREET, BLUFFTON, INDIANA BY THE CITY OF BLUFFTON
The Common Council of the City of Bluffton, Indiana is hereby giving notice that real estate owned by the City of Bluffton, commonly known as 1014 S. Adams Street, Bluffton, shall be sold at public auction on January 15, 2013, at 1:00 PM in the meeting room for the Board of Public Works and Safety of City Hall, located al 128 W. Market Street, Bluffton, Indiana. The final sale of the real estate shall be subject to the approval of the Common Council of the City of Bluffton, Indiana.
The real estate herein described and the improvements and building situated thereon (including the dwelling) are sold without warranty, either expressed or implied, of condition or fitness and the City makes no representations as to the condition of the real estate or any improvements and buildings which are not specifically set out in seller’s disclosure statement available to the any bidder therefor. Any interested bidder shall have the right to contact BKM Auction Company, 1085 North Main Street, Bluffton, IN 46714, to make inspection of the real estate or the improvements thereon. Any bidder not requesting such inspection shall waive any rights that may arise from an inspection of the mechanical, electrical, plumbing, heating and cooling systems and the roofs and structural portions of the dwelling and other buildings whether or not required by buyer’s lender. The real estate and the improvements located thereon will be sold by the City and purchased by buyer in an “as is” condition.
The City shall convey the real estate to the highest qualified bidder by Quit-Claim Deed.
The property shall be sold to the highest bidder otherwise qualified to purchase the real estate. The purchase price shall be paid in the following manner: Three Thousand Dollars ($3,000.00) cash in hand as a down payment upon the execution of this Contract for sale at the day of sale and the remainder in cash upon closing and on receipt of the deed which shall occur not later than February 15, 2013.
The real estate is more particularly described as follows:
Part of the Northeast Quarter of the Northeast Quarter of Section 7, Township 26 North, Range 12 East, bounded and described as follows:
Beginning at the Northeast corner of said Section 7, which point is marked by a stone in the centerline of the County Road; thence South along the Section line and road center line a distance of 132 feet; thence West making an enclosed angle of 90 degrees 01 minutes 13 seconds, a distance of 330 feet; thence North making an enclosed angle of 89 degrees 58 minutes 47 seconds, a distance of 132 feet; thence East making at enclosed angle 90 degrees 01 minutes 13 seconds, a distance of 330 feet to the place of beginning. Containing 1.00 acres. EXCEPT THEREFROM, a part of the Northeast Quarter of Section 7, Township 26 North, Range 12 East, Wells County, Indiana, being that part of the land described in Deed Record 148, Page 30, Office of the Recorder, Wells County, and being that part of the grantor’s land lying within the right of way lines depicted on the attached Right of Way Parcel Plat marked Exhibit “B”, described as follows: Beginning at the northeast corner of said section, designated as point “6” on said plat: thence South 0 degrees 40 minutes 35 seconds East (assumed bearing) 132.00 feet along the east line of said section to the southeast corner of the 1 acre tract of land described in said Deed; thence South 89 degrees 18 minutes 55 seconds West 50.00 feet along the south line of said tract; thence North 0 degrees 40 minutes 35 seconds West 65.77 feet to the point designated as “1733” on said plat; thence North 0 degrees 30 minutes 53 seconds West 66.23 feet to the north line of said section; thence North 89 degrees 18 minutes 55 seconds East 49.81 feet along said north line to the point of beginning and containing 0.151 acres, more or less, inclusive of the presently existing right of way which contains 0.055 acres, more or less.
IN ADDITION TO, part of the Southeast Quarter of Section 6, Township 26 North, Range 12 East, bounded and described as follows, to-wit:
Commencing at the Southeast corner of said Southeast Quarter of said Section 6; thence West in the Section line 330 feet; thence North parallel to the East line of said Section 115.5 feet and to the Section line; thence South in said Section line, 115.5 feet to the place of beginning. Containing 0.875 acres, more or less. EXCEPT THEREFROM, a part of the Southeast Quarter of Section 6, Township 26 North, Range 12 East, Wells County, Indiana, being that part of the land described in Deed Record 148, Page 30, Office of the Recorder, Wells County, and being that part of the grantor’s land lying within the right of way lines depicted on the attached Right of Way Parcel Plat marked Exhibit “B”, described as follows: Beginning at the southeast corner of said section, designated as point “6” on said plat: thence South 89 degrees 18 minutes 55 seconds West (assumed bearing) 49.81 feet along the south line of said section; thence North 0 degrees 30 minutes 53 seconds West 34.18 feet to the point designated as “1734”; thence North 0 degrees 11 minutes 56 seconds West 81.32 feet to the north line of the 0.875-acre tract of land described in said Deed; thence North 89 degrees 18 minutes 55 seconds East 50.00 feet along said north line to the east line of said section; thence South 0 degrees 11 minutes 56 seconds East 115.50 feet along said east line to the point of beginning and containing 0.133 acres, more or less, inclusive of the presently existing right of way which contains 0.048 acres, more or less.
