NOTICE OF ADOPTION FOR AREA PLAN COMMISSION

Notice is hereby given that the Wells County Zoning and Floodplain Management Ordinance & Wells County Subdivision Control Ordinance has adopted an ordinance revision on September 20, 2012 for Vera Cruz. Copies of the ordinance including the revision are available at the Wells County Public Library Bluffton Branch, 200 W. Washington St, Bluffton, IN 46714 and at the Wells County Area Plan Office, 223 W. Washington St, Bluffton, IN 46714.
1. The revision is to include the terms manure lagoon and satellite manure lagoon in the Wells County Zoning and Flood Plain Management Ordinance & Wells County Subdivision Control Ordinance.
a. Add the terms to Table 9-14 Permitted Uses in Zoning Districts.
b. Define the terms in Article 18 Definitions.
c. Amend Sections 16-01 and 16-02 to give the Concentrated Animal Feeding Operation Control Article jurisdiction over manure lagoons and satellite manure lagoons.
d. Add a new section 16-07 (5): to include engineered plans, design standards, and inspections for a manure lagoon and a satellite manure lagoon.
2. The change will affect the A-1 agricultural zoning districts.
3. The penalty for violating this ordinance is as described in IC 36-7-4-1018 “Violations; Penalties; Ordinance” and IC 36-1-3-8 “Powers Specifically Withheld”, which can include a $2,500.00 fine per violation and court action.
